Monday, April 18, 2016, James Faire’s attorney, Stephen Pidgeon, filed a motion in the Court of Appeals, Division III of the State of Washington for discretionary review of Okanogan County Superior Court Judge Christopher Culp’s dismissal of his habeas corpus.

Washington State 2nd Amendment and liberty advocate,  James (Strat) Faire, continues to fight a malicious prosecution stemming from false reports given to Okanogan County law enforcement officers. With his state and federally protected constitutional rights being grossly violated and even though he was indigent and UNLAWFULLY incarcerated, James Faire was forced to retain private counsel.

ISSUES ON APPEAL

  1. Whether the court erred in denying Faire’s Writ of Habeas Corpus, when the State failed to meet its burden of proof beyond a reasonable doubt that Faire’s due process rights had not been violated;
  2. Whether the presentation of Faire at each critical stage proceeding without benefit of counsel constitutes a violation of the Sixth Amendment;
  3. Whether the presentation of Faire at each critical stage proceeding without benefit of counsel constitutes a violation of Article I, Section 3 of Washington’s constitution;
  4. Whether the violations of Faire’s rights protected under the Sixth Amendment constitute grounds for dismissal of all charges;
  5. Whether incarceration for 173 days without benefit of counsel:  when Faire was indigent and had previously been appointed counsel; when his court-appointed counsel never brought a motion to reduce bail; and when the court could not obtain a replacement for court-appointed counsel  from August 18, 2015, to January 17, 2016, amounts to a violation of the Eighth Amendment and Article I, Section 14, of Washington’s  constitution.

Okanogan County continues to subject James to legal and financial abuse; including a draconian electronic home monitoring (EHM) program which James is required to pay for. The financial burden of fighting these false and malicious charges is overwhelming. Your support is needed to enable James to continue his fight for justice. This fight is being waged against injustice and the rampant abuse by the government; not just for one man, but for the principle of justice for all.
